THE PACKAGE

• Up to 3 hours of consecutive coverage with Hailey and assistant Eric

• Online gallery to download and share with friends and family

• Print shop access through the gallery

• Turnaround: images delivered within 4 weeks of the event date

TERMS & CONDITIONS

1. SERVICES & ENTIRE AGREEMENT The Client retains The Mighty Studio (Hailey York) to provide the photography services described above. The Client agrees that a photography assistant will attend the session to help complete the services. This agreement is the entire understanding between the Studio and the Client and replaces any prior conversations, emails, or quotes, whether written or verbal. The only way to change it is in writing, signed by both parties.

2. FEE & PAYMENT A non-refundable retainer of 30% of the Fee is due at the time of signing to reserve the date. The remaining balance is due no later than 7 days before the event date. Work on the images will not begin until the full Fee has been received.

3. RESERVATION & RETAINER Once this agreement is signed and the retainer is received, the Studio reserves the event date and turns away other bookings for that date. For this reason the retainer is non-refundable, even if the date is changed or cancelled for any reason, including reasons outside either party's control. The retainer is applied toward the total Fee.

4. LATE START & OVERTIME Coverage begins at the agreed start time. If the ceremony or the Client runs late, the Studio is not responsible for any photos that cannot be taken within the booked coverage window. If coverage runs past the booked hours at the Client's request, additional time is billed at $350 plus HST per hour, charged in full hour increments, payable within 7 days of the event.

5. CITY HALL & VENUE RULES Photography at City Hall and similar venues is subject to the rules of that location and its officials, including limits on where the photographer may stand, the use of flash, and timing. The Client accepts the technical results of any such restrictions. It is the Client's responsibility to confirm any permit, fee, or booking required by the venue. The Studio is not responsible for shots that cannot be captured because of venue or official restrictions.

6. STYLE & REAL MOMENTS The Client has reviewed the Studio's portfolio and understands its style before booking. The Studio shoots candidly and works to capture genuine moments. While reasonable requests are welcome, the Studio cannot guarantee any specific shot, pose, or list of images, and creative and editing decisions remain the Studio's.

7. COPYRIGHT & LICENSE All photographs and digital files remain the property of The Mighty Studio and are protected by copyright. Upon receipt of full payment, the Client is granted a license to use, share, and print the delivered high resolution files for personal, non-commercial use. The Client must obtain written permission before any commercial use or sale of the images for profit. The Client does not receive RAW files at any point.

8. NO ALTERATIONS The Client agrees not to edit, re-crop, recolour, apply filters, or otherwise alter the delivered images, and not to add any third party watermark. The images are to be shared as delivered. The Client is responsible for ensuring anyone they share the images with follows this clause.

9. MODEL RELEASE The Client grants The Mighty Studio the right to use the photographs for portfolio, website, social media, advertising, print, exhibition, and other promotional purposes, with no compensation owed to the Client. If the Client wishes to opt out of this use, they must say so in writing before the event date.

10. PHOTO CREDIT When sharing images online, the Client agrees to credit The Mighty Studio by tagging @themightystudio. Referrals and tags are a meaningful part of how the Studio grows, and they are genuinely appreciated.

11. DELIVERY Edited high resolution images will be delivered through an online gallery within the turnaround time noted above, measured from the event date or from the date of final payment, whichever is later. The Client is responsible for downloading and backing up their files in more than one location. The gallery remains live for 6 months after delivery.

12. SUBSTITUTE PHOTOGRAPHER In the unlikely event of illness, emergency, or other circumstance that prevents the Studio from attending, the Studio will make every effort to send a substitute photographer of similar caliber. If no substitute can be arranged, the Studio's liability is limited to a refund of all payments received, less any costs already incurred.

13. LIMIT OF LIABILITY The Studio uses professional grade equipment and back up equipment and takes the utmost care with the images. In the unlikely event that some or all images are lost, damaged, or cannot be delivered for any reason, the Studio's total liability is limited to the amount paid by the Client under this agreement.

14. CONDUCT The Studio will not tolerate abusive, threatening, or harassing behaviour toward the photographer or assistant from anyone present. If this occurs, the Studio may end the session and retain all amounts paid to that point.

15. CANCELLATION All cancellations must be made in writing. The retainer is non-refundable in every case. In addition to the retainer, if the Client cancels within 7 days of the event date, the full balance remains payable, as the date can no longer be rebooked.

16. FORCE MAJEURE Neither party is liable for failure to perform due to events beyond reasonable control, including illness, severe weather, government order, or other emergencies. The retainer remains non-refundable, and the parties will make a good faith effort to reschedule to a mutually available date.

By signing below, the parties confirm they have read, understood, and agree to this agreement in full.
