Session Agreement and Image Release

Thank you for booking with The Mighty Studio. This agreement is between The Mighty Studio, operated by Hailey York (the Studio), and the client named below (the Client). It sets out the terms of the Client's photography session so we are aligned before we shoot. By signing below, or by attending the session, the Client confirms they have read, understood, and agree to everything set out here.

SCHEDULING AND TIMELINESS The Studio runs a tight, pre-planned schedule and sessions are often booked back to back. The Client agrees to arrive on time and be ready to begin at the scheduled start time. Any time lost to a late arrival comes out of the session and does not extend it. The Studio will always do its best to begin and finish on schedule. The Studio is not responsible for delays caused by circumstances outside its control, including travel disruption, weather, equipment failure, illness, or emergencies. If such a delay occurs, the Studio will make every reasonable effort to continue the session, reschedule, or offer a suitable alternative.

LOCATION The session takes place at the address provided by the Client at booking, or within the immediate area around it as planned in advance. Locations and timing are mapped out ahead of the session, so any change to the location must be agreed in writing beforehand and may affect the schedule and the fee.

SESSION LENGTH Each session runs for approximately one hour.

IMAGE DELIVERY The edited gallery is delivered through Pixieset and remains available for six months from the delivery date. After that period the gallery may be removed to make room for new sessions, so the Client should download and back up their images within that window. Galleries are delivered in high resolution, in a curated mix of black and white and colour chosen at the Studio's creative discretion.

ADDITIONAL TIME AND REQUESTS The session covers the shooting time and the final edited gallery described above. Anything beyond that, including extra shooting time, additional edits, rush delivery, or extra deliverables, is billed at $250 per hour and must be agreed in advance.

DEPOSIT AND PAYMENT A deposit is required to confirm and hold the session date. The deposit is non-refundable under any circumstances, including cancellation or rescheduling by the Client. The deposit secures the Client's place in the schedule and the time set aside for them. Any remaining balance is due on or before the session date unless agreed otherwise in writing.

CREATIVE WORK AND BEST EFFORT Photography is a creative process. The images represent the Studio's best creative effort to capture the session. Specific shots, poses, expressions, edits, or results are not guaranteed, and the number of final images may vary from one session to another.

COPYRIGHT AND IMAGE OWNERSHIP All photographs created during the session are the sole property of The Mighty Studio and are protected under Canadian and international copyright law. The Studio retains full copyright ownership of all images. Images may not be altered, re-edited, filtered, cropped beyond minor framing, resold, distributed, or used for commercial purposes beyond the rights granted below without the Studio's written permission and appropriate licensing.

USAGE RIGHTS The Client is granted non-exclusive rights to use the delivered images for personal use, portfolio use, and posting on the Client's own social media. The images may not be used for paid brand partnerships, sponsored posts, product endorsements, commercial advertising, or any other commercial purpose without a separate written licensing agreement from the Studio.

CREDIT AND TAGGING Crediting is required and not optional. Every posted image must credit the Studio in the caption as follows: Photo by Hailey York of The Mighty Studio The account @the.mightystudio must also be tagged in both the image tag and the caption on Instagram and TikTok.

LIMITATION OF LIABILITY The Client participates voluntarily and assumes full responsibility for themselves and any guests present. The Studio is not liable for injuries, personal distress, loss, or damage incurred during the shoot. In the event of emergency, technical failure, or circumstances beyond the Studio's control that prevent delivery of the images, every reasonable effort will be made to reschedule or provide a suitable alternative.

GOVERNING LAW This agreement is governed by the laws applicable in the province where the session takes place.
