The Mighty Studio Contract, Terms & Conditions

STUDIO TERMS AND CLIENT AGREEMENT

This agreement is entered into between The Mighty Studio, hereafter referred to as the Studio or the Photographer, and the client booking photography services, hereafter referred to as the Client. By booking a session with the Studio, the Client agrees to all terms outlined below.

The Photographer is an independent contractor and agrees to provide freelance photography services. Services may include still photography delivered as digital files and or prints. Video services may be provided at the Photographer’s discretion but are only guaranteed if booked and paid for in advance.

SESSION FEES AND PAYMENTS

A non refundable retainer equal to 30 percent of the session fee is required to secure a booking. Sessions are not confirmed until the retainer is received.

The retainer is valid for a maximum of one year from the date of initial payment. If a session is not completed within this period for any reason, the retainer is forfeited.

The remaining balance is due during the week of the scheduled session. No image galleries or files will be delivered under any circumstance until full payment has been received.

ARTISTIC DIRECTION AND IMAGE SELECTION

The Client acknowledges that they are hiring the Photographer based on her portfolio, body of work, artistic vision, and editing style.

The Photographer retains full and sole discretion over all creative aspects of the session including image selection, composition, cropping, editing style, and whether images are delivered in color, black and white, or a combination of both.

Galleries are curated selections and are not a complete record of the session. There is no guarantee of a specific number of images. The gallery reflects what the Photographer determines to be the strongest images produced during the session.

Clients may not select which images are included in the final gallery.

IMAGE DELIVERY

Galleries are delivered via Pixieset and remain available for six months from the delivery date. After that time, galleries may be permanently removed.

RAW files are not provided under any circumstance. This includes but is not limited to unedited files, original captures, or partially processed images.

EDITING AND RETOUCHING

Standard editing is included and consists of basic color correction, tonal adjustments, and light blemish removal consistent with the Photographer’s established style.

Additional edits, revisions, or extensive retouching requests are not included and are billed at 150 dollars plus HST per hour with a one hour minimum. All editing requests must be paid in full before work begins.

The Photographer reserves the right to decline editing requests that are inconsistent with her artistic style or brand.

SESSION REQUESTS AND ADD ONS

Backdrop requests, props, and specific shot requests may be discussed but are not guaranteed.

Video capture may be provided at the Photographer’s discretion if not pre booked, but it is only guaranteed when booked and paid for in advance.

The Photographer may work with assistants as needed. The presence or number of assistants is not guaranteed.

For sessions involving children, the Photographer is responsible only for photography. Parents or guardians are fully responsible for supervising, managing, comforting, feeding, and directing their children as needed. The Photographer does not manage children.

RESULTS AND CLIENT SATISFACTION

The Photographer agrees to apply reasonable professional skill and judgment to produce images consistent with her portfolio and brand.

The Client understands that results depend on factors beyond the Photographer’s control including cooperation, mood, comfort level, energy, timing, and environmental conditions.

Dissatisfaction based on subjective preferences including personal appearance, facial expressions, body shape, or how one looks in photographs does not constitute failure to perform and is not grounds for refunds, reshoots, or complimentary edits.

RESCHEDULING CANCELLATIONS AND NO SHOWS

A minimum of 24 hours notice is required to cancel or reschedule a session.

Cancellations or changes made within 24 hours result in forfeiture of the retainer.

With proper notice, the retainer may be applied to a rescheduled session subject to availability, provided the new session occurs within one year of the original retainer payment date.

No shows are non refundable and non transferable.

ARRIVAL POLICY

Clients must arrive promptly at their scheduled start time. Clients may arrive no earlier than ten minutes before the session.

Clients are expected to arrive fully prepared. Time spent settling in, changing, feeding, or preparing is part of the scheduled session time.

Late arrivals will result in reduced shooting time. Sessions end at the originally scheduled time unless otherwise agreed to in advance.

LIMITATION OF LIABILITY AND ASSUMPTION OF RISK

The Client voluntarily participates in the session and assumes full responsibility for themselves and any guests including children.

The Studio and Photographer are not liable for injury, distress, loss, or damage incurred during or in connection with the session.

TECHNICAL ISSUES AND UNFORESEEN CIRCUMSTANCES

The Client acknowledges that technical issues may occur including but not limited to equipment malfunction, data corruption, or data loss.

In the event that images are partially or fully lost due to technical failure or unforeseen circumstances, the Client understands that editing or recovery may not be possible.

In such cases, the Photographer’s liability is limited to reasonable efforts to remedy the situation which may include rescheduling where possible. No additional compensation or damages will be owed.

COPYRIGHT AND LICENSING

The Photographer retains full copyright to all images created in perpetuity regardless of delivery format.

Upon full payment, the Client is granted a personal use license only. This includes personal social media sharing, personal printing, and sharing with friends and family.

Images may not be used for commercial, promotional, editorial, advertising, or business purposes without prior written permission and a paid licensing agreement.

The Photographer may reproduce, publish, exhibit, and otherwise use images for self promotion including portfolio use, website display, social media, marketing materials, and competitions unless the Client requests otherwise in writing at the time of the session.

SOCIAL MEDIA CREDIT

When sharing images online, Clients agree to credit or tag the Studio where applicable.

PRICING AND POLICY CHANGES

Pricing and policies are subject to change without notice. It is the Client’s responsibility to confirm current pricing and terms prior to booking. Previous rates will not be honored.

AGREEMENT CONFIRMATION

By booking a session and submitting payment, the Client confirms that they have read, understood, and agreed to all terms and conditions outlined above. Booking and payment constitute acceptance of this agreement.
