I’m Hailey York, a mom of four and a passionate portrait photographer. Mighty Studio offers creative, personalized branding photography, specializing in capturing the essence of your business, team, or product. Since 2023, I’ve dedicated myself to delivering standout images that help brands communicate their story and connect with their audience.

I’m thrilled to work with you! This agreement outlines the process from booking through the receipt of your final gallery. By signing this agreement, you acknowledge that you have read, understood, and agreed to all terms and conditions outlined below.

This agreement will commence on the effective date, once the initial security deposit has been received by Mighty Studio, and will remain in effect until the completion of all services. The contract will be considered complete upon delivery of the final gallery unless terminated according to the terms specified herein.

The photographer will provide the following services for your branding photoshoot:

Pre-shoot Consultation: Discussing your vision, branding goals, target audience, and preferred style.

Branding Photoshoot: Including a set number of final images based on your package (e.g., headshots, product photos, lifestyle images, team shots, etc.).

Post-Production: Editing and preparing images for final delivery.

Image Delivery: A curated gallery of final images, including the possibility of variations (e.g., color and black & white options).

Booking & Deposit: A non-refundable reservation retainer of 25% of the total booking fee is required to reserve your session date. The remaining balance is due prior to or on the day of the shoot.
Hailey will hold your booking date once the deposit is received and will not take other clients on the same date.

Pricing: Pricing is determined by the number of people or products involved in the shoot. The final fee will be agreed upon prior to the shoot and is based on the scope of work discussed.

Scope of Work: We'll define the shoot details, including time, location, and the number of people involved.

Deposit: A 25% deposit is due to confirm your session.

Photoshoot Time Constraints: We will set a clear timeline based on your specific package.

Location: Photoshoots are conducted at my home studio or a location we mutually agree on. If off location, it is likely an assistant will be required and a travel fee will be discussed.

Post-Shoot Gallery Receipt: You will receive a curated gallery of high-resolution images, the approximate number will be agreed upon prior.

Custom Requests: If you have specific requests for color versus black & white versions, please inform me in advance. Hourly fees may be required depending on the size of request.

Gallery Availability: Galleries will be available for 6 months from the delivery date.

I strive to exceed your expectations by delivering high-quality images that align with your branding goals. If you're not satisfied with the service, I welcome feedback and will do my best to address any concerns. Please note that makeup sessions, if not included in the package, are charged at the same rate as the original session.

Confidentiality: Mighty Studio will keep your identity and any proprietary business information in the strictest confidence.

Social Media and Marketing Use: Unless otherwise agreed upon, images taken during the session may be shared on social media platforms, my website, and in other marketing materials to promote my work.

Client Approval for Marketing Use: Please sign below to indicate your approval for the use of images for Mighty Studio’s marketing purposes.

Usage Rights: The images provided will be licensed for your commercial use, such as website content, social media posts, and marketing materials. Additional fees may apply for exclusive rights or extended usage beyond the scope of the initial agreement.

Termination of Agreement: This agreement can be terminated by either party under the following circumstances:

By Client: The client may terminate this agreement by notifying Hailey. In this case, any outstanding balances for services already rendered will remain due.

By Photographer: Hailey reserves the right to terminate the agreement for reasons including, but not limited to, non-payment, unreasonable demands, or inappropriate behavior. In such cases, the client will be refunded any pre-paid amounts minus the retainer fee.

Liability: Hailey/ Mighty Studio is not responsible for any personal injury, property damage, or loss that occurs during the shoot.

Force Majeure: Neither party will be held liable for any failure or delay in performance due to circumstances beyond their reasonable control (e.g., weather, natural disasters, illness).
