THE MIGHTY STUDIO

THE KIDS TABLE— Photo Release & Liability Waiver

This agreement is between The Mighty Studio ("the Studio") and the undersigned parent or legal guardian ("the Guardian") on behalf of the minor child or children participating in the above event ("the Child"). By signing below, the Guardian agrees to the following terms.

1. Photo and Video Release

  • The Guardian grants the Studio full, unrestricted, and irrevocable rights to photograph and film the Child at the event.

  • The Studio retains complete creative control over the resulting images and video, including selection, editing, and style.

  • The Guardian grants the Studio the right to use, reproduce, edit, publish, and distribute these images in any format and any medium now known or later developed, including but not limited to the Studio's website, social media, portfolio, marketing materials, press, and commercial use, without further approval, compensation, or notice to the Guardian.

  • The Guardian waives any right to review, approve, or request changes to the images prior to use.

2. Image Delivery

  • Images will be delivered via an online gallery following the event.

  • Given the nature of a group event with a high volume of children, the Studio cannot guarantee that every child will appear in a usable or favorable image, or that every child will be included in the final gallery. No refund, reshoot, or other remedy will be provided on this basis.

3. Tagging Requirement

  • If the Guardian posts any images from the event publicly, the post must visibly tag @the.mightystudio and @bernhardtstoronto.

4. Assumption of Risk and Release of Liability

  • The Guardian acknowledges that participation in the event involves inherent risks, including but not limited to physical injury, and voluntarily assumes all such risks on behalf of the Child.

  • The Guardian releases and holds harmless The Mighty Studio, its owners, employees, and contractors, and Bernhardt's, its owners, employees, and staff, from any and all claims, liability, injury, loss, or damage arising from the Child's participation in the event, except where caused by gross negligence or wilful misconduct.

  • The Guardian agrees to supervise the Child throughout the event or to confirm that another responsible adult will do so.

5. General

  • This agreement is governed by the laws of the Province of Ontario.

  • This agreement applies to all images and footage captured at the event, regardless of when they are published or used.

  • If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect.
