Photo Release Agreement: The Mighty Studio / Hailey York

This covers the photos taken by Hailey York of The Mighty Studio (the "Photographer") on [shoot date], at [shoot location / project name] (the "Images").

These photos were provided free of charge. In exchange, the terms below apply to anyone who uses them (the "Artist").

The terms

1. Use is open. The Artist may use the Images for their own purposes, including portfolio, promotion, press, and social media.

2. Credit is required, always. Every use of the Images must credit the Photographer. There are no exceptions. Suggested credit line: "Photo by Hailey York / The Mighty Studio."

3. Tag on social. Any post that uses the Images on social media must tag @themightystudio. A credit in the caption alone is not enough. The tag must be on the post itself.

4. No selling. Full stop. The Artist may not sell, license, or otherwise profit from the Images. If a paid use ever comes up, the Artist must consult the Photographer first and get written approval. Any sale requires a fee paid to the Photographer, agreed in advance.

5. The Photographer owns the Images. The Artist releases all Images to the Photographer. The Photographer holds full ownership and copyright in the Images, and may use them for any purpose without limitation, including portfolio, marketing, advertising, licensing, stock, and sale.

6. Likeness release. The Artist grants the Photographer the right to use their name, image, likeness, and any recognizable part of them as they appear in the Images, for any purpose. That includes commercial sale, licensing, advertising, marketing, and stock. This grant is irrevocable, perpetual, and worldwide, across all media now known or invented later. The Artist gives up any right to inspect or approve the Images, any edit, crop, or composite, or how and where they are used.

7. No payment owed, ever. The free shoot is the full and agreed value the Artist receives in exchange for everything in this agreement. The Artist waives any claim to payment, royalties, or any share of revenue the Photographer earns from the Images, now or at any time in the future.

8. This runs to others too. Every right granted here also extends to the Photographer's licensees, assignees, and anyone the Photographer authorizes to use the Images.

9. Governing law. This agreement is governed by and read under the laws of the Province of Ontario.

10. This is the agreement. By signing, the Artist confirms they have read and agree to all of the above, and that they are signing freely.
